The mark consists of a three-dimensional mark that is trade dress for the distinctive ornamental design features of a flat multi tool. The uppermost edge of the multi tool is straight. Beneath the upper edge of the multi tool at one end is a V-shaped notch such that the upper edge of the V-shaped notch and the upper edge of the multi tool form a longitudinally projecting strip. An ovoid arc upper end intersects the lower edge of the V-shaped notch to form a point. The lower portion of the ovoid arc intersects a straight side-edge portion that is perpendicular to the uppermost edge and parallel to a straight opposing side-edge portion that is also perpendicular to the uppermost edge. The bottom edge of the multi-tool includes a series of six generally house-shaped notches of varying size that increase and then decrease as distance from the side edge increases. The matter shown in broken lines are to indicate the position of the trade dress and are not claimed as part of the trade dress.
