The mark was first used anywhere in a different form other than that sought to be registered at least as early as 03/01/2018
The mark consists of a literal element of the word "TICKING", which is the literal mark object of protection. Also, the brand consists of a design that is composed of an isotype and a logotype, together imagotype. The isotype has bilateral symmetry on an axis located in the center of the design. It consists of an anthropomorphic design, evocating a king, with a three-pointed crown and an elongated rhombus in the center in the way of a jewel. The face has, instead of eyes, two timers that evocate eyeglasses, as well as it has a thick and stylized beard and mustache. The logotype consists of the word "TICKING", diagramed in the typographical font "MONT FONT", with extended interletration. The "T" and the "K" in capital letters, and the "I" located to the right side of the intervened "K", has been substituted in the point of the "I" by a crown similar to the isotype. The design is presented in white color on a black background, with the exception of a section on the right side of the time meters in the eyeglasses and the crown in the logotype which are both presented in yellow. The black background shown in the design and described above is only used in order to be able to appreciate the design, but it does not constitute part of the design. The literal elements and design described in the terms in which it has been described, including the colors used in the whole description of the imagotype, are claimed.
