The mark consists of a three-dimensional configuration comprising a specific design feature of the product packaging for a bottle that is a foil cap and label that wraps around and covers the entire bottle. The label consists of a white square in the lower front middle of the bottle; on the perimeter of the white square is a thin silver line, inside of which are the words "BAREFOOT BUBBLY", with the "BAREFOOT" capitalized and in purple, and the "BUBBLY" in small letters underneath "BAREFOOT" and intersecting with it slightly, and in rainbow colors, namely, running from red to orange to yellow to green to medium blue to purple through the letters. Above the word "BAREFOOT" is a purple stylized solid footprint. Around the square is a thin silver line, and in the background are different sized brushstroke stripes of color from top to bottom being light blue, pink, white, pink, and light blue with specks of white appearing due to the inconsistent finish. Just underneath the neck of the bottle are two stripes of purple, and the neck and cap are covered in purple foil. The bottom of the bottle below the square label and the bottommost brushstroke stripe is purple. The shape of the bottle is not claimed a feature of the mark, and is depicted in dotted lines for the purpose of showing the position of the mark on the goods.
