The mark consists of the three dimensional trade dress design of the FOOT DEFENDER(TM) lower extremity ambulatory protective device for which the following primary features are claimed:(a) Multi-Patterned Rubber Sole (Bottom)- The bottom of the rubber sole has five different textured patterns and three different shades, including two circles with a large three-dimensional zig zag pattern inside of each circle, and a smaller three-dimensional zig zag pattern outside of the circles, in addition to a textured border with three-dimensional horizontal stripes surrounding the outside border of the sole. In between the two circles is a smooth trapezoid shape in a dark shade. (b) Two-Tone Rubber Sole (Side)- The side of the sole features two parallel and horizontal rubber stripes in contrasting shades that run along the entire circumference of the device. In the lower half of the sole, the lighter shade stripe splits to create a border for a trapezoid shape in a darker shade. The horizontal stripes also feature three-dimensional notching patterns to the right and left of the trapezoid. This feature is symmetrical and appears on both the inner and outer portions of the sole. (c) Zig-Zag Pattern: A zig-zag pattern in a light shade appears on the back left portion of the device. It begins at the top of the device and travels down toward the sole, where it turns to the right and extends horizontally to the middle of the device. This feature is symmetrical and appears on both the back left and back right portions of the device. (d) Piping: There is a three-dimensional piped border in a contrasting color outlining the zig-zag pattern on the back left portion of the device and the triple-notch shape on the front panel of the device. This feature is symmetrical and appears on both the left and right sides of the device. (e) Small Circle Patterns: Sixteen three-dimensional circles appear on the right side of the upper portion of the device within the zig zag pattern. This feature is symmetrical and appears on both the upper right and left portions of the device. (f) Large Circle Patterns: Seven large three-dimensional circles appear in a rectangular box on the front upper portion of the device. (g) Triple-Notch Shape On Front Panel: The front panel of the device features a triple notch shape in a dark shade, with a light three-dimensional piped border outlining the notches. Each notch contains a piped three-dimensional trapezoid shape in a dark shade with a three-dimensional horizontal line in a light shade within the trapezoid. The triple-notch shape creates two cutouts in the front panel. This feature is symmetrical and appears on both the right and left sides of the device. The matter shown in broken lines, namely, the outline of the device along the front and rear panels are not part of the mark. The broken lines serve only to show the position or placement of the primary features of the trade dress. Color is not claimed as a feature of the mark.
