The mark consists of An "internet-of-things" packaging design. The "internet-of-things" (IoT) are small devices that communicate with radio frequencies (BlueTooth, Wifi) to generate real-time data, and other applications. LionRT Inc. is a manufacturer of unique IoT devices that utilize this design in the stream of commerce (1). The device is a wireless sensor that responds time-based communications to a remote wireless sensor network infrastructure (i.e. chronologically), hence the name "Temps Alert" that translates to "Times Alerts" in French. IoT devices such as ours, and others, utilize 3.3V - 3.5V of energy during operations (2). This created a unique need to utilize lithium-ion batteries operating within 3.5V - 3.7V since the desired voltage was not available with standard alkaline batteries. Lithium batteries are available as packs and cylinders. It has been shown that cylinder lithium batteries are associated with enhanced pressure equalization during dangerous failures (3). As a result, LionRT Inc. utilizes model 18650 lithium batteries for the safety and regulatory standards of consumer applications. The mark is a configuration of LionRT Inc. custom printed circuit boards (PCBs) that are utilized for "internet-of-things" (i.e. remote cloud operations) applications. This shape and configuration has no effect on the IoT board's functionality. The internal functionalities of the IoT devices are wholly and uniquely defined by the PCB, and not by the enclosure. This also includes the rechargeable circuitry that is a function of the PCB, and not the design and/or enclosure. Under Section 2(f): Features of a product's design can never be inherently distinctive and are registrable only upon a showing of secondary meaning. LionRT Inc. remains the only manufacturer of IoT devices to date that utilize this shape and configuration packaging for our products. Our customers identify and know us by the design and shape of the proposed mark. This specific design and configuration is one of many possibilities available for two 18650 batteries. The inspiration of this design was to have a Fibonacci-compliant pattern for design best practices (4). The current shape and design is at approximately 1" H x 3" W x 5" T where two 18650 batteries are arranged perpendicular to the PCB.
