Color is not claimed as a feature of the mark.
The mark consists of a curved band (26.17.09) that begins on the left, then slopes upward as it goes to the right and thins out to a point; and, below the thinned out portion of the curved band, a triangle (26.05.25) tilting approximately 40 degrees to the right to line up with the band above, whose sides are slightly rounded inward. Both shapes are solid, and beneath the shapes is the literal element BUTTERSCOTCH.
