An exception to Applicant's use of the mark which is the subject of this application throughout the United States may be rights secured to Four Seasons Heating & Air Conditioning, Inc (the "Concurrent User"). Applicant claims the exclusive right to use the mark which is the subject of this application, FOUR SEASONS HEATING & COOLING, in the area comprising the entire United States, except for the geographic area comprised of the cities of Chicago, Cicero, Bridgeview, Oak Lawn, Tinley Park, Orland Park and Chicago Heights, Illinois and the area containing those cities which lies directly to the east and southeast of the city of Chicago, Illinois. The present Applicant is advised of claims that under the mark FOUR SEASONS, the Concurrent User is offering services similar to those offered under Applicant's mark in the aforementioned geographic area for which Applicant does not claim exclusive use of said mark, but the Applicant has no knowledge of the truth or falsity of such claims by the Concurrent User, the periods of use of a similar mark or the modes of use of a similar mark by the Concurrent User. The Concurrent User, to Applicant's belief, is doing business at 6510 S. Lavergne Ave., Chicago, Illinois 60638.
