The Applicant will allow use of the Mark by manufacturers, for one or more one-year terms, exclusively if (a) the manufacturer is a business entity or division of a business entity that provides evidence or certification, to the satisfaction of the Applicant, that no less than 65% of its workforce is employed within the United States, and/or (b) the Applicant has determined, relying on evidence or certification, that either (i) no less than 65% of units of such goods sold worldwide are manufactured in the United States, or (ii) no less than 65% of the cost of the components, manufacture and packaging of such goods is paid to contractors with operations principally within the United States. Such criteria are minimum criteria; the Applicant may refuse a license to use the Mark in its discretion.
