Applicant respectfully disagrees with the Examiner's conclusion that the term "fresh grain" is merely descriptive, and must be disclaimed. Nonetheless, so as to avoid the effort and expense required to argue against the requested disclaimer, the Applicant has entered the disclaimer. This disclaimer, however, does not constitute an express or implied admission that the phrase is "merely descriptive."
