Concurrent use information. Applicant requests that said mark be registered in the United States Patent and Trademark Office on the Principal Register established by the Act of July 5, 1946, and claims exclusive right to use the mark in the area comprising the State of Hawaii. The following are exceptions to Applicant's right to exclusive use of the mark: Farrell's International, Inc., a California corporation, with a principal place of business in Laguna Niguel, California ("International"), which is using or has the right to use the trademark PIG'S TROUGH in connection with ice cream desserts in the States of Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, Wyoming, Puerto Rico, the United States Virgin Islands and any other territories of the United States, but for the State of Hawaii. Farrell's International, Inc., hereby consents to the concurrent use registration of the trademark PIG'S TROUGH by Farrell's Pacific, LLC, in Hawaii, for use in connection with ice cream desserts.
