Accordingly, the color yellow is a feature of the "Anna Rossi Beauty Mark," noting that the colors gold and blue are shaded around the clam shell image. [See the attached] I therefore claim the color as an integral feature of the Mark. The color appears in the lettering, i.e. the Logo of the Mark. The appearance of the color as contained in the Mark consists of a Logo created by stylizing a general splash on a positive and negative format. Rectangles are divided once in two (2) sections. Additional rectangles are completely and/or partially shaded. See 37 C.F.R. § 2.52(b)(1); see also TMEP § 807.07 et seq. Accordingly, common colors that describe the Mark are gold and blue. See TMEP § 807.07 (a)(ii). A concise description of the Mark in accordance and pursuant to the meaning and definition promulgated by the enactment of 37 C.F.R. § 2.37 and TMEP §§ 808 et seq. is the following: the Mark consists of two (2) rectangles forming a large rectangle and the designation "Anna Rossi Beauty" is indicated in the center of the space between the two (2) rectangles.
