To my knowledge, there has never been a single incidence of trademark confusion. The Applicant, Concord Insurance Group (CIG) only does business in New England, on the East Coast of the U.S. In fact, 95% of the Applicant's business is conducted in Massachusetts. The remaining 5% is conducted in Rhode Island, Connecticutt, New York, New Hampshire, Maine and Vermont. California Capital Insurance Company uses CIG in California, on the West Coast of the U.S. As such, due to the geographical exclusivity, there is no reasonable likelihood of confusion. Applicant seeks trademark protection in these states: Massachusetts, Rhode Island, Connecticutt, New York, New Hampshire, Maine and Vermont.
